1. Definition
For the purposes of this Privacy Policy, the following definitions shall apply:
- “Administrator” means any person who has credentials to log in to the Customer account to manage it, create polls, view and share poll results, or manage the account, enabling individual users to leave feedback;
- “Privacy Notice” means a notice sent to respondents at the time of responding to Customer’s polls, including the degree of privacy and/or anonymity the respondent will have while responding to the poll;
- “Happy Inc”, “Happy Job”, “we”, or “our” tools;
- “Customer” or “Company” means a person or entity that has contracted Happy Job. to enable you to use Happy Job. Services. As a rule, your employer or a specific subgroup (i.e., division, department, etc.) within your employer will act as a Customer or a Company;
- “Personal Profile Page” means a page enabling platform users to view poll results;
- “Individual Feedback Graphs” mean graphs or charts displayed on your Personal Profile Page created based on feedback messages provided to you by other users;
- “Platform Data” means any content or data that you or any third parties submit to Happy Job using the Services;
- “Respondent” means any person who gets access to our Services to respond (fully or partially) to polls carried out by the Customer using the Services;
- “Services” mean all products (including applicable mobile applications), services, and websites offered by Happy Job;
- “Visitor” means any person who visits our websites;
- “Websites” are www.happy-job.hk and other websites operated by Happy Job that refer to this Privacy Policy;
- “You” or “your understanding” means an Administrator, a Respondent, an Individual Feedback User, or a Visitor, as the case may be.
We may update this Privacy Policy from time to time, and the latest version will be published on our Website. In case of any significant changes, they will come into effect only after we notify you either via email (the notification will be sent to the email address linked to your account) or by displaying a message the next time you log in to your account. We advise you to regularly check this page for getting the latest information about our Privacy Policy. 2. Note on children
Unless permitted by the applicable law, you should prohibit children under 16 to use our Services. We deliberately avoid collecting personal information from minors under the legal age. If a minor sends personal information to Happy Job, and we get to know that this information belongs to a child under the legal age, we will try to delete the data in the shortest time possible. If you believe we may have any personal information about any child under the legal age, please contact Happy Job at sales@happy-job.kz.

- Usage information: we collect depersonalized (anonymized) usage information about you whenever you interact with our Services. (b) Information about AdministratorsandRespondents

- Information collected from your Company: each Customer provides us with different information. In most cases, your Company will provide us with demographic information, such as your name, email address, and other information related to your role at the Company, including data about your manager, direct reports, and your position within the organizational structure of the Company. Some customers may provide us with additional demographic information to help them better analyze and understand polls results. If you are, or become, part of a Network, your Company may ask us to create an account for you (if you are not an Individual Feedback User).
- Poll responses: when you answer the Customer’s poll, we save your responses and comments.
(c) Information about Administrators
We may collect the following information about Administrators:
- Credentials: when you sign up for an account, or another Administrator creates an account for you, we collect information about your name, company name, email address, password, and other information.
- Poll data: when you create and conduct polls using the Services, we save poll questions and other information associated with these polls.
- Payment details: if you use a credit card for billing purposes, our credit card processor may collect information like the cardholder name, payment address, email address, credit card number, expiration date, and credit card security code.
- Account settings: you may customize or update settings and personal information on your account settings page or in your profile For example, you may specify your name, email address, default language, or time zone.
4. Who controls and processes the data?
Data protection law in certain jurisdictions distinguishes between a “controller” and a “processor” of information. For Administrators, Respondents, and Individual Feedback Users, your Company (which is our Customer) will serve as the controller of your personal information, while Happy Job will be its processor. For Visitors, Happy Job will generally serve as a controller of their personal information.
5. How do we store the collected information?
(a) Security of your personal information
The security of your personal information is very important to us. All of your data is private and confidential, and we take reasonable measures to ensure the safe use of your personal information following this Privacy Policy. We follow generally accepted security standards to protect personal information during its transfer and after its acquisition. Happy Job is ISO 27001 certified.
However, you should keep in mind that information transfer via the Internet could never be completely safe. Although we do our best to protect your personal data, we cannot guarantee that it will be totally safe in all and any situations.
Security is a collaborative effort; thus, we also advise you to create a complex password for logging in to our Services and keep it private.

- customize your user experience (including the provision of our Services in the format convenient to you or the device you use to access our Services);
- develop new services or features;
- ensure the adherence to contract specifications and policies in case we become aware of potential violations;

- investigate complaints against you or filed by you;
- send you a welcome email to confirm ownership to the email address you provided during the account registration;
- send you an email when you are appointed as an Administrator of your corporate account;

- respond to legal requests, such as summons, warrants, or other mandatory information requests.
- Generate anonymized aggregated data: to help customers better understand their polls’ results, we use polls’ anonymized aggregated data to compare Customer results to other polls or other Customers’ results. We also use your poll’s data to continuously improve our Services, including our anonymized aggregated data sets. No data from your poll will be shared with other unrelated Customers in an unaggregated or identifiable form.
- Respond to legal inquiries and prevent harmful consequences: if we receive a legal inquiry or are informed of a situation that may inflict harm or potential harm to somebody, we may need to verify your personal information or data to respond appropriately to that inquiry or threat.
- Identify you as a user: we may use your information to identify you as a Respondent in our systems.
(e) Visitors
When you use our Services as a Visitor, we may use your personal information to:

7. Who has access to your personal information?

- Prevent illegal actions or ensure the adherence to contract specifications and policies: if you participate, or threaten to participate, in any illegal activity, we may reasonably believe that we should disclose your personal information to the police, the appropriate authority, the law enforcement agency, your Internet service provider, employer, supervisor, or network administrator.
- Protect our rights or the rights of our employees: in some cases, the disclosure of your personal information is necessary to protect the property, health and safety of Happy Job or its employees, customers, or other people. For example, we may share information with other organizations to protect you against fraud.
- Keep other organizations informed: sometimes, we may need to disclose your personal information to our agents, affiliates, joint ventures, partners, investors, any applicable subsidiaries, or holding companies. The need to disclose your personal information to these organizations may arise because of a legal obligation to them or the desire to pursue our or their legitimate business interests.
- Host events, run contests, and conduct promotions: we may be required to disclose your personal information to sponsors and promoters when you register, attend an event, or participate in any contest we host or promote. This disclosure generally does not apply to Respondents or Individual Feedback Users.

(c) Disclosure of information on Respondents or Individual Feedback Users
When you use our Services as a Respondent or Individual Feedback User, we may also disclose your personal information to:
- Provide Services: when you respond to Customer polls, we disclose this information to the Customer and Administrators. The way of displaying your responses and the type of information used to analyze and share your responses (in the aggregated and individual form) may vary from poll to poll. It is important that you read the Privacy Notice before answering poll questions to understand how your responses will be used and how they will be shared (if applicable). Your poll data will also be visible to other employees at your Company every time you share your poll reports or provide feedback to such an employee. Your Company and other employees will not be able to see your Personal Profile Page, but your personal information may be used to provide the Services to other users on your network.
- Create anonymized aggregated data: we may create anonymized aggregated data for any purpose based on the available data about you. For example, we may create anonymized aggregated data for its further transfer to customers, prospects, partners for business or research purposes, or for rendering our Services (e.g., providing polls benchmarks).
- Fulfill Customer requests: since the Customer is your personal information controller, we store and process your personal information on the Customer’s behalf. Sometimes the Customer may instruct us to disclose your personal information to a third party (e.g., to a consultant or a new service provider). If the Customer is instructed to disclose your personal information to a third party, we will sign a data transfer agreement with the Customer and the third party (if needed) to ensure that they continue to comply with the Privacy Notice for each poll.
- Prevent harmful consequences: we may also disclose your personal information to the Customer or appropriate government authorities if your use of our Services indicates an imminent risk of harm to you or others.
8. What are your rights to your personal information
If you live in certain European Union countries, you may have rights for your personal information, including the right to access, correct, delete, transfer, restrict or stop using or disclosing your personal information.
We will respond to your requests to access and update (if needed) personal information as soon as possible.

Such information includes data uploaded to our Services by the Customer (e.g., your name, email address, employment and demographic data), your polls responses and comments, as well as individual feedback you submit using our Services.
While exercising your rights, you have the following options:
- Connect with the platform: if you do not want to receive emails from the Happy Job platform, you need to contact your Company. If you contact us directly, we will forward your request to the Customer to get their permission and/or instructions. After making this request, you may no longer be able to use the Services.
- Correct and delete the Platform Data: if you would like to request access, correction, transfer or deletion of your Platform Data, you need to contact your Company. If you contact us directly, we will forward your request to the Customer to get their permission and/or instructions. Please note that when Happy Job corrects or deletes your Platform Data, information related to you may be inadvertently identified by the Customer due to its omission.
- Exceptions to Platform Data correction: if you are an individual feedback user, you may change any personal data in your account (except for continuous feedback messages, performance reviews, and your personal feedback charts).
9. How long do we store your personal information
(a) Administrators, Respondents, and Individual Feedback Users
We store your personal information for as long as we provide our Services to the Customer, or until the Customer asks us to delete your personal information, or for as long as it is necessary to comply with our legal obligations, resolve disputes, or ensure our legal rights observance.

We will store your personal information as long as we provide you with our Services or as long as it is necessary to comply with our legal obligations, resolve disputes, or ensure our legal rights observance.
